CBDT Notification 64/2026: The 76 Corrections to the Income-tax Rules, 2026 Explained
On 16 April 2026, the Central Board of Direct Taxes (CBDT) issued Notification No. 64/2026 [G.S.R. 286(E)], a corrigendum to the Income-tax Rules, 2026. It makes 76 corrections to the text of the Rules as first published in the Gazette on 20 March 2026. Four of the corrections are to three rules; the other 72 are to 39 forms in Appendix III. Most fix numbering, typing and cross-reference errors, but a handful change what a form asks you to fill in, including removing Aadhaar fields from several statements and adding a Yes/No answer to Form No. 178. This post sets out what was corrected, who needs to care, and what to check before you file.
Key Takeaways
- What it is: Notification No. 64/2026, G.S.R. 286(E), dated 16 April 2026, is a corrigendum to G.S.R. 198(E) dated 20 March 2026, the notification by which CBDT made the Income-tax Rules, 2026 under section 533 of the Income-tax Act, 2025. The Rules came into force on 1 April 2026.
- Three rules corrected: the marginal heading of Rule 165 (updated return), the stray sub-rule number in Rule 229 (production of certificate under section 420), and two references in Rule 243 (crypto-asset reporting) that said “section” instead of “rule”.
- Forms whose content changes: Form No. 56 (Master File), Form No. 58 (intimation by a constituent entity of an international group), Form No. 178 (statement of exempt income of a specified fund) and Form No. 75. Aadhaar fields are removed or replaced by PAN in Forms 72, 74, 76, 79, 163 and 181.
- The rest is housekeeping: typing errors in the transfer pricing method tables of Form No. 48, “my/our” changed to “my” in five verifications, and renumbered notes, headings and clauses across the other forms.
- No rate, threshold or time limit is changed by any of the 76 items.
What Notification 64/2026 Does
The Income-tax Rules, 2026 were notified by CBDT in exercise of its powers under section 533 of the Income-tax Act, 2025, vide G.S.R. 198(E) dated 20 March 2026. Rule 1(2) says they came into force on 1 April 2026. Notification No. 64/2026 (F. No. 370142/41/2025-TPL), signed by Pankaj Jindal, Joint Secretary, is headed “Corrigendum”. Each of its 76 items points to a page of the 20 March 2026 Gazette text and says which words, figures or rows are to be substituted or omitted.
The corrigendum does not state a separate date from which the corrections apply. It simply directs the changes to the text of G.S.R. 198(E).
The Three Rules That Were Corrected
| Item | Rule | As published on 20 March 2026 | As corrected |
|---|---|---|---|
| 1 | Rule 165: furnishing of updated return of income under section 263(6) | Marginal heading ended “read with sub-section (2) of said section” | Heading now ends “read with 263(2)”. The body of the rule is not touched. |
| 2 | Rule 229: production of certificate under section 420 | The rule began “(1) Any person leaving India shall…” but had no sub-rule (2) | The “(1)” is omitted, so the rule reads as a single provision |
| 3 and 4 | Rule 243: reporting requirements for transactions of crypto-asset under section 509 | Sub-rule (1) referred to obligations “under section 242” and due diligence procedures “under section 244” | Now “rule 242” and “rule 244”, which are the rules on the reporting obligation and on due diligence procedures |
Rule 165 governs the updated return, which a person eligible under section 263(6) of the Act furnishes in Form ITR-UN. Section 263(2) of the Act is the provision under which the Board may prescribe the form of the return of income and the manner of its verification. The correction makes the heading cite that sub-section by number.
Rule 243 sets out what a reporting crypto-asset service provider must maintain and report for each relevant calendar year starting on or after 1 January 2026. In the Act, section 242 deals with the jurisdiction of Assessing Officers and section 244 with a change of incumbent of an office, so the old wording pointed to unrelated provisions. After the correction, Rule 243 correctly ties the reporting duty to Rule 242 (who must report) and Rule 244 (due diligence procedures).
Corrections That Change What a Form Asks For
| Form | What the form is | Correction | Items |
|---|---|---|---|
| Form No. 56 | Master File: information and documents to be furnished by a constituent entity under section 171(4) | Note 1 now says the name shall include the full name of the person, “constituent entity or group name”, instead of “specified fund or stock broker” | 17 |
| Form No. 58 | Intimation by a constituent entity resident in India of an international group whose parent entity is not resident in India, for section 511(1) | Part B, Sl. No. 7 (details of the parent entity: name, address, country of residence) is substituted with a restated row | 18 |
| Form No. 178 | Statement of exempt income under Schedule VI [Table: Sl. No. 10], filed for a specified fund | Part B, Sl. No. 11 now asks for a Yes/No answer: whether all the units of the specified fund are held by non-residents, other than units held by a sponsor or a manager. Note 3 drops the words “of the specified fund”. | 70, 71 |
| Form No. 75 | Statement of income paid or credited by a Venture Capital Company or Venture Capital Fund, to be given to the person liable to tax under section 222 | Note 1 now refers to the “Venture Capital Company or Venture Capital Fund” instead of the securitisation trust | 31 |
| Forms No. 72, 74, 76 and 79 | Statements of income paid or credited by a securitisation trust (section 221), a Venture Capital Company or Fund (section 222), a business trust (section 223) and an investment fund (section 224) | “PAN/Aadhaar” becomes “PAN” in the tables giving details of the persons who receive or are credited with the income; in Forms 74 and 76 the separate “Aadhaar” column in Sl. No. 7 is omitted | 26, 28, 29, 32 to 35 |
| Form No. 163 | Information and documents to be furnished by an Indian concern under section 506 | The “Aadhaar” entries at Sl. No. 9(i)(d) and 9(ii)(d) are omitted | 67 |
| Form No. 181 | Audit report under rule 289(12) for an electoral trust | “PAN/Aadhaar” at Sl. No. 6(x) becomes “PAN” | 74 |
| Forms No. 72, 73 and 75 | Statements by securitisation trusts and Venture Capital Companies or Funds | The contact number row, which carried “Country Code” twice, now reads “Country Code” and “Number” | 25, 27, 30 |
Typing, Numbering and Cross-Reference Fixes
- Form No. 48 (report from an accountant under section 172 on international and specified domestic transactions): items 10 to 15 fix typing errors in the tables headed RPM, CPM, TNMM and CUP (the resale price, cost plus, transactional net margin and comparable uncontrolled price methods), such as “adjustme t” to “adjustment”, “befor” to “before”, and “articulars” and “Particula s” to “Particulars”.
- Verifications: “my/our” becomes “my” in the verification by an accountant in Forms No. 44 and 45, in the verification in Form No. 79, in paragraph 3 of the verification in Form No. 172, and in the certificate in Form No. 179 (items 8, 9, 36, 69 and 72).
- Note and clause references: Form No. 55 now refers to “Note 4.A-3” instead of “Note 5.A-3” (item 16); Form No. 105, Sl. No. 27(i) refers to “(h)” instead of “(g)” (item 50); Form No. 166 changes “A.1.3” to “A.1.4” (item 68); Form No. 2 corrects annexure codes to “A-1” and “A-6” (items 5 and 6).
- Stray words removed: the words “drop down” in Forms No. 104, 111 and 180 (items 40, 60 and 73) and the words “Notes for the systems and its entries” in Form No. 117 (item 66).
- Renumbering: notes, headings, clauses and row labels are renumbered or relettered, or stray numbers omitted, in Forms No. 16, 62, 64, 66, 83, 84, 96, 105, 106, 107, 113, 114, 115, 116, 186 and 187. Form No. 105 alone accounts for 17 items.

What to Do Now
- Keep the corrigendum with your copy of the Rules. If your team works from the Gazette text of 20 March 2026, mark it as corrected by Notification No. 64/2026 dated 16 April 2026.
- Re-check any draft of the 39 forms prepared from the uncorrected text, starting with Forms No. 56, 58, 75 and 178 and the forms that no longer ask for Aadhaar.
- Form No. 178: make sure Sl. No. 11 is answered Yes or No.
- Crypto-asset reporting: read Rule 243 with Rules 242 and 244, as the corrected text requires.
- Citations: when you cite Rule 165, 229 or 243 in a reply or submission, cite the Income-tax Rules, 2026 as corrected by Notification No. 64/2026.
Later Amendments to the Income-tax Rules, 2026
A corrigendum fixes errors in the text as published; an amendment changes the law. CBDT has amended the Rules several times since 16 April 2026. The amending notifications on incometaxindia.gov.in include:
- Income-tax (Second Amendment) Rules, 2026: Notification No. 94/2026, G.S.R. 646(E), dated 21 July 2026, substituting clause (c) of rule 157(5).
- Income-tax (Third Amendment) Rules, 2026: Notification No. 97/2026, G.S.R. 656(E), dated 24 July 2026, amending rule 332 and inserting Appendix IV with Form ITR-BN, the return for block assessment.
- Income-tax (Fourth Amendment) Rules, 2026: Notification No. 120/2026, G.S.R. 822(E), dated 17 September 2026, amending rules 160, 176, 225, 246 and 256 and substituting Forms No. 169 and 171.
- Income-tax (Fifth Amendment) Rules, 2026: Notification No. 121/2026, G.S.R. 830(E), dated 22 September 2026, in force from 1 October 2026, amending rules 215, 218 and 219 and Forms No. 132 and 141.
None of these four notifications amends Rule 165, Rule 229, Rule 243 or any of the 39 forms corrected by Notification No. 64/2026.
What the Corrected Rules Leave to Be Specified
Two of the corrected rules leave technical detail to the Income Tax Department’s systems wing:
- Rule 165(3): the electronic verification code for an updated return is generated “as per the data structure and standards specified by the Principal Director General of Income-tax (Systems) or Director General of Income-tax (Systems)”.
- Rule 243(9): the crypto-asset statement is furnished online to the Director or Joint Director of Income-tax (Intelligence and Criminal Investigation) “in accordance with the data structure specified in this regard by the Director General of Income-tax (Systems)”. Under Rule 243(11), each reporting crypto-asset service provider must communicate the details of its designated director and principal officer to the Director General of Income-tax (Systems) and obtain a number for furnishing the statement.
Frequently Asked Questions
Does Notification 64/2026 change any tax rate or deadline?
No. None of the 76 items changes a rate, a threshold or a time limit. The items correct headings, references, typing, numbering and some form fields.
From when do the corrections apply?
The corrigendum does not state a separate date. It is dated 16 April 2026 and directs changes to the text of G.S.R. 198(E) dated 20 March 2026. The Rules themselves came into force on 1 April 2026. If a specific filing or notice made before 16 April 2026 turns on corrected text, take advice on those facts.
Which forms now ask for PAN instead of Aadhaar?
“PAN/Aadhaar” becomes “PAN” in Forms No. 72, 74, 76, 79 and 181. The separate Aadhaar column is omitted in Sl. No. 7 of Forms No. 74 and 76, and the Aadhaar entries at Sl. No. 9(i)(d) and 9(ii)(d) are omitted from Form No. 163.
What changed in Form No. 178?
Sl. No. 11 of Part B is substituted so that it reads: “Whether all the units of the specified fund are held by non-residents other than units held by a sponsor or a manager: Yes/No”. As published on 20 March 2026, the question had no answer field. Note 3 now reads without the words “of the specified fund”.
Did the corrigendum change what Rule 165 requires for an updated return?
No. Only the marginal heading changed, to cite section 263(2) by number. The requirement to furnish the updated return in Form ITR-UN and the table on the manner of furnishing are unchanged.
How should I cite a corrected rule?
For example: “Rule 243 of the Income-tax Rules, 2026, as corrected by Notification No. 64/2026 [G.S.R. 286(E)] dated 16 April 2026”. This makes clear which text you rely on.
Where can I read Notification 64/2026?
On the Income Tax Department’s website, incometaxindia.gov.in, under Notifications, listed as “Notification No. 64/2026 [F. No. 370142/41/2025-TPL] / GSR 286(E) : Corrigendum”. The same site carries the Income-tax Rules, 2026 as notified on 20 March 2026.
Practical Takeaway
Notification 64/2026 is a clean-up, not a policy change. For most taxpayers it changes nothing of substance. It matters if you prepare Forms No. 56, 58 or 178, run a securitisation trust, venture capital vehicle, business trust or investment fund that files Forms No. 72 to 79, or report crypto-asset transactions under Rule 243. For those teams, check each form against the corrected text before filing, and keep the corrigendum with your copy of the Rules.
